PEAK Grantmaking is committed to protecting your privacy and to holding any information received in strict confidence. This policy is designed to clearly communicate how our foundation collects, uses, shares, stores, and protects your personal information and data.

We may update this policy from time to time and encourage you to check back periodically to review PEAK Grantmaking’s most updated Privacy Policy.

When This Policy Applies

This policy applies to personal data we collect about individuals, through our website, online portals, electronic forms, surveys, and social media pages (“Sites”).

This policy does not apply to data that is not collected on our Sites, such as personal information submitted as part of an application for employment with PEAK Grantmaking.

Third-Party Sites

Our Sites may contain links to other websites, beyond those maintained by PEAK Grantmaking. However, once you use these links to leave our Sites, you should note that such sites are not governed by this privacy policy and we are not responsible for the protection and privacy of any information you provide while visiting such sites. You should exercise caution and review the privacy policy applicable to each website you use.

What Information We Collect

Information You Provide About Yourself

We collect information from you when you register with us or when you use certain features on the Sites. For example, you may provide your name and email address to receive newsletters. If you choose to contact us by commenting on a social media outlet, you may provide your social media handle, as well as any other personal details you choose to include.

It is your choice to determine whether or not to provide any personal data. However, certain of our Sites’ functions require you to provide various personal information, in order to fully utilize the Sites’ functions.  For instance, in order to register to attend a PEAK Grantmaking event like the annual conference, apply for membership, or create a LEARN profile, you must provide personal information which includes: your name, title, organization, work phone number, work email address, and additional personal information such as your professional interests.

Please do not disclose more personal data than is requested when interacting with us.

Data Provided by Third Parties and Other Sources

We may receive personal data about you from other sources, including your company/organization, professional references, publicly-available sources, third-party analytics providers, and other third parties. For example, we may receive your personal data if: someone at your company/organization designates you as a contact person for that company/organization or includes information about you in proposal documents; another visitor includes it in any feedback, comments, photos, videos, or other information submitted via online portals, electronic forms, surveys, or interactive portions of our sites (as applicable); or one of our employees or service providers (or a third party acting on apparent authority) provides it to us when registering you to participate in one of our events.

Data We Collect Automatically

We also may use cookies and similar technologies to automatically collect data about your interaction with our Sites, including referring webpage, pages visited on our Sites, and crash data. A cookie is a small text file that asks permission to be placed on your computer’s hard drive. Once you agree, the file is added. Cookies help us analyze web traffic and understand how you engage with our Sites. Cookies are commonly utilized by most Internet users. You can always choose to accept or decline cookies, however this may prevent you from taking full advantage of the Sites. More information about cookies is available at www.aboutcookies.org.

If you “opt in” to receive newsletters, updates, or other information from us, our emails may use a “click-through URL” linked to content on our Sites. When you click one of these URLs, they pass through a separate web server before arriving at the destination page on our Sites. We use this click-through data to help us understand how recipients respond to, or interact with, our emails.

Financial Information

To accept financial contributions to PEAK Grantmaking, payments for event registration, purchasing publications, and other resources, we process financial information, such as credit card information. However, we use a secure third-party payment processor and we never store your financial information. Any information we collect when a product or service is purchased is handled in accordance with our records retention policy.

Information We Do Not Collect:

Our Sites are not intended for minors (individuals under the age of 13, or equivalent minimum age depending on jurisdiction), and we do not knowingly collect personal data from minors. If you become aware of any personal data we have collected from a minor, please contact us. If we learn that we have collected personal data from a minor, we will take steps to delete the data without notice as soon as possible.

Additionally, certain portions of our Sites collect “special categories of data” under the EU General Data Protection Regulation (GDPR) for the purpose of improving PEAK Grantmaking’s services and operations.  Special categories of data that PEAK might collect include personal data revealing racial or ethnic origin, and other demographic data that PEAK collects.[1]

Why We Collect Your Personal Data

We collect information about you for the following reasons:

  • communicating with you about PEAK Grantmaking’s resources and work;
  • enabling you to participate in webinars and events;
  • informing our program strategies and charitable activities for our legitimate interests;
  • managing any technical issues or support requests that may arise;
  • safeguarding and improving our Sites, systems, events, and operations for our legitimate interests, generally.

Who We Disclose Your Information To

PEAK Grantmaking Staff

We share information about you as an individual to PEAK Grantmaking staff to enable us to perform services requested by you or with your prior consent. Any personal information provided to PEAK Grantmaking staff is confidential and protected and may be disclosed only under specific conditions and with prior written authorizations and consents.

Agents, Affiliates, Service Providers, and Partners

We may also share your personal data with our employees, agents, and affiliates who have a business need to know, our services providers (including consultants, contractors, vendors, and out-sourced service providers) to process it for us based on our instructions and for no other purpose, and with partners that are collaborating with us to execute projects or host events.

Other Visitors to Our Sites

If you submit feedback, comments, photos, videos, or other information to interactive portions of our Sites, such submission may be made publicly available to anyone who visits those areas of our Sites. Other visitors may access, re-post, or use such submission. Even if you remove or delete your submission, copies may remain in cached or archived areas of our sites or retained by other visitors. Please use your discretion when submitting personal data in these contexts.

Law Enforcement

We may share your personal data with law enforcement, other government agencies or authorities, or third parties as required by applicable law, court order, subpoena, warrant, or legal process served on us. We may also share your personal data in the event an individual’s safety or security is at risk.

Marketing

We do not share your personal data with any third party (including our service providers) for marketing purposes. If you believe personal data you provided to us is being misused by a third party, please contact us right away.

Confidentiality

PEAK Grantmaking is the sole owner of the data collected on the Sites. PEAK Grantmaking will not sell, rent, share, exchange, or otherwise disclose data to others outside of PEAK Grantmaking, except as described in this privacy policy. PEAK Grantmaking will attempt to collect and store the data in a manner to protect its confidentiality.

Security

Keeping information about you secure is very important to us. We maintain reasonable physical, technical, administrative, and organizational measures to prevent unauthorized disclosure of, or access to, personal data, including, as applicable, performing regular self-assessments and we strive to protect your personal information by limiting access to personal data and requiring that individuals authorized to access personal data maintain the confidentiality of that data. However, we cannot ensure or guarantee the security of any information which you send to us.

Unsubscribe

Our electronic communications provide users the opportunity to opt out of receiving future automated communications from us. If you wish to unsubscribe to a PEAK Grantmaking-related newsletter you receive from a third-party provider, please follow the third-party provider’s instructions located in the publication to unsubscribe. You may also unsubscribe from PEAK Grantmaking communications by contacting us at info@peakgrantmaking.org. Please note “Unsubscribe” in the subject line of your email.

Consent

By interacting with PEAK Grantmaking’s Sites and providing your personal information, you agree to the terms of this privacy policy. The Sites are operated in the United States. If you are located outside the United States, please be aware that any information/data you provide to us will be transferred to the United States, which may provide a lower level of protections as those in your own country. By using the Sites, you consent to this transfer, retention, and processing of your information in the United States.

Limitation of Liability

The information contained in the Sites is for general information purposes only. The information is provided by PEAK Grantmaking, and while we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the Sites or the information, products, services, or related graphics contained on the Sites for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

In no event will we be liable for any loss or damage, including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of the Sites.

Governing Law/Jurisdiction

The laws of the United States, and in particular, the State of Delaware shall govern with respect to all issues arising out of this privacy policy and the Sites. By using the Sites, you agree to the exclusive jurisdiction of State and Federal courts in Washington, D.C., in all matters arising out of or relating to this privacy policy and the use of the Sites. If accessing the Sites from another jurisdiction other than the United States, you agree to comply with all United States laws.
